1. Lobbying from AI companies 2. Legal loopholes. Since AI technically creates a brand new image based on pre-existing images, some people were getting away with it because the language of the laws defined creating CP in such a way that using AI generation wasn’t a crime.

“In 2023, 27 Democratic representatives in Colorado voted against a bill (HB23-1135) that upgraded the penalty for indecent exposure in front of a minor from a misdemeanor to a class 6 felony.” Their reasoning was that it would disproportionately affect homeless people who don’t have clothing and like to be around children, and it would also result in nude drag shows being banned for kids.
