
BDS bans are plainly unconstitutional to anyone with principles and a basic understanding of the Constitution. However, the people who decide what’s constitutional or unconstitutional are completely lacking in principle, and they support Israel. So they’re not gonna strike that shit down. Even though the violation is flagrant.
The legal argument for BDS bans being Constitutional rests on the idea that: A) The laws do not apply to private personal conduct, only business conduct. B) They do not ban businesses from boycotting Israel, they can boycott, they just forfeit state government contracts by doing so. C) Boycotting Israel as a company is not political speech, but discrimination on the basis of national origin, making it a routine anti-discrimination policy. However, these are all fairly easy points to counter.
