It also encourages perpetrators to “leave no witnesses” to come forward

Oh this is an interesting take, do you think ppl would not report to show mercy? What is a better solution (bc clearly the one we have rn is not enough to stop it)?

It’s used as a weapon against the victim. Child victims are assaulted by a known person in the majority of cases. A family member/close family friend/parent of a friend/trusted individual. So in addition to current methods used against child victims to keep them quiet, why would you give the abuser the ammo of being able to say “shhh don’t tell anyone, if you do they’ll KILL me! You don’t want me to DIE do you? You’ll get me KILLED if you share our secret”

Oh I never thought about that before but that’s so true… couldn’t they just use that line of convincing now regardless of its validity? Also couldn’t the same argument be made for any punishment for the rapist though? “They’ll send me away if you tell our secret and that would make X-person very sad, do you want to make x-person sad?!”

They could only up to a certain point, ie the victim being old enough to understand laws and whatnot. Speaking of older victims, there’s also a huge problem that many victims don’t see themselves as victims, or don’t want to see their abuser punished so harshly so they avoid coming forward. Punishment meaning death will increase that unwillingness. Why give a victim that moral choice? It’s not their morals they should grapple with at that point
