so basically the Texas folks fucked themselves by calling it a racial gerrymander, which is illegal but partisan gerrymandering is somehow legal, so if California can successfully argue it wasn’t about race the map might stand

The current definition of illegal gerrymandering is if it is explicitly race-based. That’s what fucked texas’s attempt. If California avoids describing it as racial in any way they might be able to proceed with it.
