
to build off your point, police officers are supposed to be judged by a standard of objective reasonableness (Graham v. Connor), not the officers mindset at the time, and this was an objectively unreasonable response. She was calm, the other officers at the scene antagonized the situation, she was turning away from the officers, and he only fired AFTER he was out of the way. That fails the objective reasonableness standard.
Someone tried to correct me on this but I looked it up, officers are not allowed to fire at drivers unless they are 100% certain they are using the car as a weapon meant to cause them harm. Given the fact that people were yelling at her to drive, and his response to being bumped, neither of them were expecting contact which means I don’t think he thought she was using her car as a weapon. So yeah, clearly an unjustifiable response
She didn’t? The car didn’t accelerate fast until after he killed her (because that’s what happens when you shoot the driver of a moving vehicle). She had been ordered to move her car by the other ICE officer and was complying, the shooter then ran in front of her car and was yelling contradictory (and unlawful) orders and also curse words at her.
