I mean in a capitalistic framework you have a point, but even if such a thing should exist I feel like the patent should be shorter lived. And what if the plant cross pollinates with other plants that grow in the wild in your region? Is it really the same plant anymore?

It makes sense you have to selectively breed and spend millions on research trying to get it viable for mass growth. These are also tend to be specialized with a single goal. Lays for example made a special type of potato to make chips They aren’t the only the crops used by everyone like onions, green beans etc

Most crops don’t cross pollinate. You forget that most are just the same plant grown on mass. Like bananas or Apples. Seeds are grown thanks to human hands and can’t be grown with out them kinda like how cows and certain breeds of dogs require humans during their birth. So cross pollination is out of the question really The bare basics for eating aren’t patented. These are just taster versions of them.

I thought I had replied but my app decided to be dumb. I primarily work with flowers, and my issue is what if a patented cultivar of whatever plant interbreeds with my native plants? Particularly things such morning glories, asters, and coreopsis, you can’t control bees

The legal precedent for this situation is not really in favor of the person whose plant gets interbred with

If it happens naturally without interference then it’s allowed. Again the problem is modern crops require human intervention. I dare you to try to grow a banana tree from a banana. So while it can happen it’s most likely not Crops are very different compared to flowers.

But my point is, the same laws apply to all plants, both crops and ornamental flowers
