Hateful protests or rallies whether “peaceful” or not should always be banned. No hateful gathering can ever truly be peaceful. KKK marches, pro life marches, pro police/ICE marches, etc should all be banned.

Who decides what is hateful?

That just means the government can ban any protests it doesn’t like. It’ll just call BLM protests “hateful anti-white riots,” pro-Palestine demonstrations “antisemetic protests,” pro-abortion protests “baby murder rallies,” and any protest critiquing the administration would be “hateful to patriotic Americans”

Like it would take approximately 3 seconds for the ability to ban peaceful protests to be used to just silence anyone the government dislikes.

And that’s why we need a competent government in office to make sure the only things that are banned actually need to be

And I’m not saying any of those protests I listed are actually hateful. They aren’t. But the government can just fuckin lie if it feels like it. Already does all the time.

Their could be guidelines put in place in a new amendment that would outline exactly what constitutes hateful gatherings

The rational non-fascists in the government

See the thing is that a benevolent dictatorship is that it’s the ideal form of government, but it will never actually exist. Because all governments are vulnerable to corruption.

Your list of hateful gatherings includes pro-police marches. The police fuckin suck. But if you distill it down, that’s just a protest in support of a government agency. It’s a problematic agency, but if you can define that as illegal, what stops this from silencing protests which are against defunding a library or giving rid of the department of health?

And once we set the precedent that you can arbitrarily arrest people for free speech the government considers distasteful, ho boy you can bet it’ll expand as much as possible. Britain is already arresting pro-Palestine protestors as being “terrorism supporters”

How do you guarantee that only rational non-fascists have power?

They’re downvoting you because you’re right. This is also already happening to pro-Palestine protesters in Germany and Australia

That amendment would have to be incredibly specific and I don’t think any country has figured that out yet. All of the countries that tried banning “incitement to hatred” or related activities are also cracking down on pro-Palestine protests to some extent
