
This isn’t even new by the way. ICE has been doing this since their founding in 2003. They have been known to detain American citizens knowingly until the statute of limitations is up on their ability to pursue legal action for false imprisonment (Watson v. United States, No. 16-655 (2d Cir. 2017))
This same thing happened in 2018 btw, a man born and raised in the US was wrongly identified as a Jamaican immigrant. So when he was arrested for a parole violation, he was detained by ICE instead. They claimed his birth certificate was fake due to a different birth date listed (common issue). That suit is still ongoing but got favorable rulings to be moved forward JUST THIS YEAR (Peter Brown)
