I think it is misleading. If the victim was in reality a man while the judge tricked the jury into thinking he was a woman, it’s definitely a mistrial. Men and women are fundamentally different strength wise. The defendant claimed there was a scuffle.

If strength had relevance then how come the strength of the woman in question was not mentioned in court? This has nothing to do with someone being trans or not. Strength was never mentioned in court because it wasn’t relevant. The man was found guilty of manslaughter, only for the upper courts to overturn it purely because the victims trans status was not explicitly mentioned despite it not being relevant

It is relevant? Men are stronger than women. Jury considered a scuffle between a man and a woman. In reality it was a scuffle between 2 men. That’s the issue.

Men are stronger on average, but averages don't decide self-defense cases. The question is whether this specific person posed a deadly threat to this specific defendant in that moment, and the jury heard the evidence about the actual scuffle. A label doesn't change how strong someone actually was, and plenty of women are stronger than plenty of men. Also, shooting someone six times over a "scuffle" is the part that needs explaining.

Average strengths mean jack shit but also even if it meant anything if she was far enough in her transition to be stealth like it seems I guarantee she had closer to an average cis female strength than average cis male strength. Hormones change your body composition very quickly. My friend and I started hrt at roughly the same time and before she easily could have whooped me in strength but by 6 months our relative strengths had completely flip flopped

Hormones are the most defining sex characteristic that contribute to biological function difference. Hrt makes the body function identically to the primary sex it contributes to. I started T and scared myself with how much stronger I got while doing literally nothing different. Achieved massive gains by sitting on my ass doing homework. It’s really crazy and I don’t think it can really be understood unless you go through it. I didn’t think the metabolic rate and muscle mass differences would be so striking
