there's technically supreme court precedent i think, a kid lived a botched electric chair and his lawyer argued that he already received his death penalty punishment and to receive a second would be double jeopardy. supreme court ruled 5-4 that he could get the chair again

States do retain the right to seek another death warrant. It happened recently with Kenneth Eugene Smith However I do think it’s important to note this is the first case someone has survived the actual drug administration. Previous botched injections resulted from failure to set the lines correctly. She actually has a really good case for cruel and unusual punishment compared to previous attempts on lethal injection botches
