The right to an abortion is not a fundamental right. The state has a very strong interest in preserving human life which already fails the strict scrutiny requires to pass what’s called the Glucksberg Test (which decides if a right is fundamental). And therefore, a non-fundamental right is subject to regulation and limitations.

As controversial as it may be, Roe V. Wade should never have been passed n the first place. Even Justices Gins Berg (May she rest in piece) and Sotomayor said that it was obsolete almost a year after it was decided.

Down vote me all you want. It’s a simple fact of the law. The right to medial procedure for non-life threatening situations, are not a fundamental right nor a constitutional right.

If that’s so stupid, then why does the Supreme Court uphold that position? Even the dissents (the disagreements), said that Roe V. Wade needed to be overturned, just not how it was done in Dobbs V. Jackson.
