Normally yes. However, if the opposition is actively attempting to form a fascist political regime, and in so doing actively participated in and committed crimes, is it really the same thing? (Assuming all of them get actual due process)

I mean if they get *actual* due process and the judge is unbiased with no conflicts of interest and the jury is genuinely impartial, then sure, but that doesn’t sound like what OP’s calling for
