
deterrence doesn't hold up. the national research council concluded there's no reliable evidence the death penalty deters crime. and most rape victims know their abuser, often family. making rape a capital crime gives rapists a reason to kill the only witness and makes victims less likely to report someone they love. the supreme court cited both of those when it struck it down for child rape. if we want fewer rapists, we need upstream prevention, not downstream reaction.
"do both" doesn't work when one side is killing people. prevention means believing people can change, and an execution says they can't. and those countries don't prove deterrence. their rape numbers look low because victims often don't report, since they can be shamed or even punished themselves. saudi arabia also uses the death penalty against gay people. that's not a system built to protect victims, it's a system built for state control.
