If we wanna get philosophical with legal interpretations I think that would fall under act of god. Like if your well maintained tree limb fell and killed your neighbor. You weren’t negligent, you’re not liable for the death. That was an act of god.

If it was caused by clearly evident negligence I suppose it would be. Case law on pre roe is pretty supportive of this too

Probably. You can’t just outright criminalize miscarriages and you need some evidence of intent even if it’s bs evidence. I don’t have tons of trust in our systems but I have enough to know wide spread frivolous criminal campaigns against all women wouldn’t work out well. Otherwise nearly every woman would be in prison and then who would they fuck? The twink shortage is bad enough they can’t have any
