
Criticizing the text of a law does not mean supporting what that law claims to be against, and this mindset is how messily written laws get passed without sufficient scrutiny. A law that says “any member of a government-designated terrorist organization can be arrested” sounds good, but the government can designate any group as a terrorist organization. But if one criticizes that law it’s met with “oh so you support terrorists????”
This law could be used to criminalize the possession of material depicting lgbtq+ characters (“obscene” is a very broad label). Possession of an inappropriate drawing of a 17 year old anime character without knowing that character’s age could lead to arrest. If a high schooler doodled a stick figure of himself with a big dick that’s now illegal material.
The types of drawings this law wants to give rid of are gross and shouldn’t exist, but 1. Are lines on a page of a fictional character and 2. Are too widespread on the internet for this to be implemented. You can’t put a law like this into place without widespread identification of the ages of characters, or without widespread removal of this content from social media platforms. Otherwise it’s just too widespread and difficult to identify.

I definitely see where you’re coming from, but teenagers do sometimes get convicted of CP distribution and have to register as sex offenders for sending selfies of *themselves*, which clearly isn’t the intent of those laws and we live in an era where laws are not read in good faith. I think for any particular individual it’s far fetched this would happen bc of some anime teen, but it just seems too vague to be good legislation
Basically just did the “oh so you’re secretly terrorist then if you don’t like this law???” accusation. I avoid that shit because it’s gross and have never been to Texas. But you can’t expect the Texas government of all things to use this law only against people causing actual harm. It’s Texas, they very easily could use the broadest possible definition because they both hate lgbtq people and porn as a concept.
It’s pretty straightforward imo. Because in court, they also have to prove the age of the individual drawn. And if it is as ambiguous as anime lover #1 claims it could be, then very often it wouldn’t be proven beyond a reasonable doubt and the case is thrown out. However, if you’re making content of a well known underage character, then yeah, you got caught. If you’re stressing, it’s an admission of guilt
