I hate the guy but he is objectively correct, apart from the blatant propaganda. It was self defense. TN v Garder (1985) and Graham v Connor (1989) unfortunately set that precedent.

She was turning her fucking car around and complying with orders. It wasn’t self defense at all

If she truly was in the wrong how come the agent fled the scene afterwards?

You’re quoting cases that support that this is not self defense💀

Yes. But the initial shots were bc she was driving with agents swarming her car. “…OR OTHERS” he had reasonable suspicion to believe that she was going to drive into them or others

I posted TN v Garder which explicitly says “ the use of deadly force to prevent escape is an unreasonable seizure under the 4A”

Significant threat of DEATH or SERIOUS PHYSICAL INJURY. Which were not present

Yes. Driving a vehicle with people around is an example of suspect posing a threat of serious physical injury to the officer OR OTHERS.

He was the only one in front of the vehicle ( more towards the left front bumper ) the car has hard turned right. He could reasonably move out of the way ( which he did and continued shooting ) and no one else was in danger

why even shoot??? Why wasn’t shooting her tires their initial reaction

Yes exactly. The second and third shot he made were when he was completely out of the way and no one was in any danger. So he was perfectly able to move out of the way of the vehicle without getting any injury.

So by your logic we shouldn’t drive cars through college campuses since there are people around Or after concerts Or at amusement parks Or anywhere with a crosswalk Or anywhere with any form of a parking lot Genuinely how does your comment make ANY sense at all..

Even if I was to humor your dumb ideology, how do you explain them refusing to allow her medical attention afterwards? A physician was on site and begged them to let them attempt life saving care and they refused to let the physician help
