
This misunderstands consent. Consent can be withdrawn at any point, and it's an ongoing agreement, not a one-time yes. But regret after the fact doesn't legally turn sex into assault; the question is whether there was consent at the time. Knowingly filing a false report is already a crime. Often when someone "retracts" later, it's because they're realizing they didn't really feel free to say no in the moment, and that deserves to be taken seriously, not criminalized.
Everyone has free will. If someone you are engaging with has your consent it’s not fair to “realize” you didn’t want to all along. You are fully responsible for you actions at the end of the day whether you are inebriated or not. Kinda like saying you don’t deserve a DUI because you had impaired judgment and wouldn’t have done it otherwise. That being said, I am fully against a sober person taking advantage of someone who is impaired. Coercing an impaired person while sober is wrong.
