You should be able to take legal action against them!

Unfortunately my friend, I am very broke. I would spend more fighting her than just paying it and moving out. But I shall be informing everyone I know about this and ruining her chances of getting a diff apartment

Hey, I’m studying law. I believe you’re misguided in your beliefs with this. Take this to small claims, small claims courts pretty much never use attorneys and it would be easy for you to get a judge to side with you. You can self represent, and ask AI to help you build up a decent pitch for the judge. The judge will set you straight.

You’ll have to pay a filing fee, but you’ll more than likely get your $1000 back.

Ok, here’s my thing? My landlord basically said because the lease doesn’t specify that she HAS to pay half, she can’t enforce it. And to my knowledge, the ex roommate talked to a lawyer too

The landlord can’t enforce it? So you don’t owe anything?

No she can’t enforce that the other girl pays her half, that’s what the landlord told me. That since it doesn’t explicitly say she pays half and I pay half, as long as the total is paid, it still fulfills the lease.

I see, all this means is that the landlord can’t enforce it. Judges in small claims can go by implied agreements & course of conduct (how you and your roommate have paid in the past). This is one of the most common small claims inquiries, judges see it all the time. Look up legal tenant clinics in your county and you can get free consultation. You have a case, don’t let people stop you.
