
In legal contexts it’s often used when the sentence is explicitly meant to refer to an individual and does not apply to groups. “They” ofc exists as a singular, but using it leaves ambiguity because it also exists for groups. It still drives me crazy tho bcos the layperson doesn’t know that and therefore it enforces transphobia
My old boss, when we’d have a NB client, would add a sentence to the Definitions section of whatever document it was saying something to the effect of “Wherever “they, them, or their” is used, it means [client] or [client]’s and is not to be understood as referring to the plural usage of the same word thereof.” It’s not hard for lawyers to keep up either. Their whole job is disambiguation and they clearly possess the capacity to do so here.
