I know girls with videos of their rape who still couldn’t get a prosecution. That DUI BS? The reason it’s ever made into a gender issue is because something around 95% of all sexual assault is committed by a man, including sexual assault on a man. I just looked it up. In the original title IX hearing in May, Jane Doe herself stated that she was drinking heavily before she ‘consentuallly’ took ketamine after it was offered for the first time. She is stated saying ‘you don’t look dead or asleep necessarily the lights are on, but no one’s home. Your brain is not functioning at its proper level.’ Other witness (Kretzschmar, a frat guy) said he went upstairs and saw nothing… which doesn’t align with the evidence (groupchat, and other accounts)
Part of the reason the punishment was so light was because she already admitted to consensually taking the drug and drinking. Does that make her treatment right or that she is less deserving of justice? No. Also K’s POV doesn’t make much sense as people had already admitted to seeing her, but claimed they thought it was consensual (idk if they stopped to check for drugs or thought ‘free P*’ meant something positive that shouldn’t be investigated??).
She made the report because she did not consent while sober to multiple men sleeping with her which is SA and blurs between the lines of 🍇 . She also did not consent to sleeping with MORE man, and her testimony + others proves she was (consensually) under the influence. Her story has never changed, though the public has muddled the details.
Either way tho, the ruling happened and gave the expect results according to the practice. People don’t really consider the way that courts often avoid overturning/overriding a previous rule unless absolutely necessary. Voluntary intoxication cases are frequently treated like this. At least she told the truth back in May tho

There is a mandatory title IX training that actually goes over this in detail. Just because two drunk people consent doesn’t mean that everything is now legal. In fact, trainings tell you what to do in that situation.
