TO BEGIN: Hospitals have lawyers as well. And hospitals have LOTS of lawyers SPECIFICALLY TO MAKE SURE they win malpractice suits. And medical malpractice is tortious conduct, so most of the time no one is going to jail unless they REALLY fucked up.

How bad must you fuck up? BAD. You can leave a scalpel inside of a person’s body and not go to jail. You can PERMANENTLY DISABLE SOMEONE and not go to jail. You can kill someone and not go to jail.

Now what happens if my doctor fucks my shit up when I’m unconscious in surgery? Well, now you gotta prove how they did it & who did it. But your honor, I WAS UNCONSCIOUS! okay plaintiff! i see your struggle! we will shift the burden to the hospital to prove you did get your shit rocked

great! EXCEPT “the conspiracy of silence” PREVENTS DOCTORS FROM SAYING WHO FUCKED UP because they don’t wanna snitch on their friend cuz then the whole hospital is mad at them!

Now you the plaintiff need an outside voice of reasons! cuz these doctors are in a cult together to protect the hospital & each other in case they fuck up. But that expert witness HAS TO BE AWARE OF THE CUSTOM OF THE LOCALITY. which means they gotta know the area. Which means your expert witness probably ALSO knows those doctors. Now isn’t that sucky.

So basically, the system is rigged, medical malpractice is almost never criminally prosecuted and rarely successful & you’re far more likely to be disbarred for doing the level of dumb shit doctors do & get away with than lose in your med mal suit. thank you.
