Unless they can prove he was doing that intentionally and wanting to “show off” through the window, legally he is not at fault by being naked and doing naked things in his own private residence. At the same time, don’t do things in places other people can see if you don’t want them to see it

There’s nothing wrong with recording people in public view. Especially if they are being predatory. At some point the mother notified him and instead of stopping he continued to masturbate knowingly in the view of a child. Predators commonly place themselves in situations where you can questions the victims asking. Somehow everyone fails at recognizing this

He is absolutely in the wrong, I just hate when posts like this ignore the wrongs performed by the other party. I’m sympathize that she doesn’t want her or her son to see that but the article claims after recording she only tried to call the cops once but got placed on hold and “gave up”. Like sure that sucks but how is the next logical step to take this footage to the news?

I’m definitely not saying that at all. It’s just a simple fact of prior case law on similar scenarios. He is disgusting for doing that but I wanted to point out that he might not get into legal trouble for it. She made the situation much worse for herself by not badgering police about it like OP said. I’m also disheartened by the media for adding that picture. I work in the news and I know that was completely unnecessary for the story.

Maybe it depends on the state, but that’s a crime where I’m at. Doesn’t matter if it’s your own house or if it was unintentional, being naked in front of an open, easily visible window will lead to you catching charges. Especially if it’s seen by children.
