Rape is a type of SA, but not all SA can be counted as rape. In this case it isn’t rape bc rape is unconsensual sex(meaning forced penetration from either party, man or woman)

This isn’t true. My father is in jail for molestation and sexual assault of a minor NOT RAPE. He touched and put his mouth on my vagina and the police knew this and that is on the documents. Rape Is the forced penetration vaginal or anal using objects or body parts. For a man to be raped the woman has to forcibly penetrate herself either thru anal or vaginal penetration. Rape is very specific and everything else falls into other types of sexual assault.

Actually that is partly true, it really depends if the place you are filing the report. Some laws don’t count that and some do, I just did research on it. But in Virginia it isn’t considered rape it’s forcible sodomy, look it up!

But it does because the law defines what it is. It’s the law and thats what it is. And the biracial thing isn’t true, most places go based on the race of one of the parents and by state. For example as a biracial person born in VA my birth certificate says white because they went based on mother’s race but my brother who is also biracial and born in Utah has black on his birth certificate. And being biracial most of the time you are looked at as black by white people and white to black people.

The law isn’t everywhere..so when one state says something and another says something else..how do we figure out the facts? Just like abortion laws. Just because one state is against it and another state is for it, how do we determine what’s right or wrong? I’m going based off facts..not one state’s law

I’m black and see biracial people as biracial. My black family sees biracial people as black. So it’s different everywhere so you can’t really say what the facts are

You should go based on facts in your own state. It’s stupid to tell this guy it’s rape when if he went to report it, IT WOULDN’T BE COUNTED AS RAPE. It’s important to know what things are regardless of the other states. That’s like saying all abortions are illegal just because it is in a few states. Or saying it is completely legal when it isn’t in some states. It’s called being logical.

Hun do you know what a FACT is? It can be proven. The biracial thing is an OPINION meaning it can change. The fact is that in VIRGINIA the bj would be forcible sodomy not rape. And that’s is a FACT BECAUSE IT CAN BE PROVEN. Not an opinion.

No and you can look it up. Under Virginia Law code 18.2-61 defines rape as sexual intercourse( including vaginal or anal penetration, however slight) committed against the person’s will by force, threat, or intimidation, or with someone who is mentally or physically incapacitated, or with someone who is underage and cannot legally consent.

So if anal sex is sodomy, how is it rape? Oral sex is sodomy, but not considered rape..so if forcible sodomy is a different crime than anal sex should not be rape

That is the broad definition( from google so it’s not very specific to the states and laws) by definition technically sodomy is both. The laws in each state determine what counts as rape and what is sodomy, like I said I’m going off Virginia which counts anal as rape and labels oral as forcible sodomy.

You’re right, my first comment was based on personal experience(which is also a case that happened in Texas)but after your reply I did research as I responded which is why the rest of the thread is based on Virginia and our laws here.
