The assumption is that people would be fair and reasonable when judging them. No one chooses to be racially profiled, that’s something that comes from someone else’s bigotry.

Most Immigration lawyers and USCIS warns immigrants about tattoos being able getting you deported, it’s not really racial profiling

Right, but that’s because they run the risk of having their tattoos being interpreted for gang alliances/affiliations or something of that nature, so they’re playing it safe by not having them, but that is because of the discrimination. It’s still an assumption based on their identity, which in many cases leads to deportation like this article says.
